Terms of Service

Welcome to TinyBio ("we", "our", or "us"). These Terms of Service ("Terms") form a legally binding agreement between you ("you" or "user") and TinyBio governing your access to and use of TinyBio.me, its subdomains, mobile interfaces, APIs, and all related products, features, and services (collectively, the "Service").

By accessing, registering for, or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately stop using the Service.

IMPORTANT: These Terms contain a binding arbitration clause, a class action waiver, and broad limitations on our liability. Please read them carefully.

1. Eligibility & Use of the Service

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, whichever is higher) to use TinyBio. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

You agree to use the Service only for lawful purposes, in compliance with all applicable local, national, and international laws and regulations, and in accordance with these Terms.

You represent and warrant that you are not located in, under the control of, or a national or resident of any country subject to a U.S. government embargo, and that you are not on any U.S. government list of prohibited or restricted parties.

2. Prohibited Content & Conduct

The following content and behavior are strictly prohibited on TinyBio. Violations may result in immediate termination without notice or refund. See our Acceptable Use Policy for full examples and a reporting form.

2.1 No Adult or Sexual Content.

TinyBio is a strictly non-adult platform. You may not upload, link to, embed, promote, advertise, sell, or solicit:

  • Pornography, nudity, sexually explicit imagery, audio, or text
  • Sexually suggestive or "softcore" content, fetish content, or sexual services
  • Escort, "sugar," cam-site, OnlyFans-style adult, or any other adult-entertainment links or referrals
  • Sex toys, adult merchandise, or any sexual products or services
  • Any content that sexualizes, depicts, or references minors in any way (immediate termination and reporting to authorities)

2.2 Other Prohibited Content.

You may not post, link to, or use the Service for:

  • Illegal activity of any kind, including the sale of illegal goods or services
  • Hate speech, harassment, threats, bullying, or content targeting any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristic
  • Violence, gore, self-harm, suicide promotion, or terrorist or extremist content
  • Fraud, scams, phishing, pyramid schemes, "get rich quick" schemes, or deceptive practices
  • Intellectual property infringement, including pirated software, music, video, or counterfeit goods
  • Malware, spyware, viruses, or any code intended to harm users, devices, or systems
  • Personal data of others without consent (doxxing)
  • Spam, unsolicited advertising, or bulk content distribution
  • Misinformation, including deepfakes, election interference, or health misinformation
  • Regulated goods including firearms, ammunition, explosives, drugs (legal or illegal), tobacco, vaping products, or gambling services where prohibited
  • Cryptocurrency scams, "rug pulls," unregistered securities, or unlicensed financial services

2.3 Prohibited Conduct.

  • Attempting to hack, reverse engineer, scrape, disrupt, overload, or exploit the Service
  • Using bots, crawlers, or automated systems without our written permission
  • Circumventing rate limits, security measures, or access controls
  • Impersonating another person, brand, or entity
  • Creating multiple accounts to evade enforcement actions
  • Reselling, sublicensing, or commercially redistributing access to the Service

3. Accounts

You are responsible for:

  • Maintaining the confidentiality and security of your account credentials
  • All activity that occurs under your account, whether authorized by you or not
  • Promptly notifying us of any unauthorized access

You agree to provide accurate, current, and complete information at registration and to keep it updated. We may refuse, suspend, or reclaim any username at our sole discretion, including usernames that infringe trademarks, impersonate others, or are reserved for system use.

We are not liable for any loss or damage caused by unauthorized access to your account.

4. User Content & License

You retain ownership of the content you create and post ("User Content").

By submitting User Content, you grant TinyBio a worldwide, non-exclusive, royalty-free, fully paid-up, transferable, sublicensable license to host, store, reproduce, display, distribute, modify (for formatting and technical purposes), publicly perform, and create derivative works of your User Content for the purposes of operating, providing, promoting, and improving the Service. This license survives termination to the extent required to maintain backups, comply with law, or operate archived public profiles.

You represent and warrant that you own or have all necessary rights to your User Content and that it does not violate any third-party rights or applicable law.

You are solely and fully responsible for your User Content. We do not endorse, verify, or assume responsibility for any User Content.

We reserve the absolute right to review, refuse, remove, edit, or restrict access to any User Content at any time, in our sole discretion, with or without notice and without liability.

5. Public Profiles

TinyBio is designed for public sharing. By default, your profile, links, blocks, and content are publicly accessible and may be:

  • Viewed, copied, screenshotted, or shared by anyone
  • Indexed, cached, and displayed by search engines and AI systems
  • Featured in our directory, marketing materials, or social channels

You acknowledge and accept that public content cannot be reliably "un-published" once shared.

6. Fees, Payments & Pricing

We reserve the unrestricted right to introduce, modify, increase, or remove fees and pricing at any time, for any reason, with or without prior notice.

Without limiting the foregoing, we may at our sole discretion:

  • Begin charging fees for features that were previously free
  • Move features between free, paid, or premium tiers
  • Change subscription pricing, billing intervals, currencies, or payment terms
  • Impose usage-based fees, transaction fees, or platform fees on payments processed through the Service
  • Establish quotas, caps, or limits on free usage

If you purchase a paid plan or feature:

  • You authorize us and our payment processors to charge your payment method for all applicable fees and taxes
  • Fees are billed in advance and are non-refundable except where required by law
  • Subscriptions automatically renew at the then-current price unless canceled before the renewal date
  • Failed payments may result in immediate suspension or downgrade

All fees are exclusive of taxes, which you are responsible for paying. Continued use of the Service after a price change constitutes your acceptance of the new pricing.

7. Suspension & Termination

We reserve the absolute, unilateral right to suspend, restrict, throttle, or terminate your account and access to the Service at any time, for any reason or no reason, with or without notice, and without any liability to you.

Without limiting the foregoing, we may take such action if, in our sole judgment:

  • You violate, or are suspected of violating, these Terms or applicable law
  • Your conduct creates legal, regulatory, reputational, financial, or operational risk for us, other users, or third parties
  • We receive a complaint, takedown request, court order, or law-enforcement request
  • We discontinue the Service or any feature
  • It is necessary to protect the security or integrity of the Service

Upon suspension or termination:

  • Your access and any associated data, content, links, subscribers, or analytics may be permanently deleted
  • Your username may be released or reassigned
  • You forfeit any unused prepaid fees and have no right to a refund
  • You remain liable for any obligations accrued prior to termination

You may stop using and delete your account at any time. Sections that by their nature should survive termination (including content license, disclaimers, liability limits, indemnity, arbitration, and governing law) will survive.

8. Intellectual Property

All right, title, and interest in and to the Service, including all software, code, designs, trademarks, logos, and content created by us, are and will remain the exclusive property of TinyBio and its licensors. These Terms grant you only a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose.

You may not:

  • Copy, modify, distribute, sell, lease, or sublicense any part of the Service
  • Reverse engineer, decompile, or attempt to extract source code
  • Use TinyBio branding, name, or logos without our prior written permission
  • Train any machine learning or AI model on the Service or its content without express written authorization

9. DMCA & Copyright Complaints

If you believe content on TinyBio infringes your copyright, send a notice to support@tinybio.me with: (a) identification of the copyrighted work; (b) the URL of the infringing material; (c) your contact information; (d) a statement of good-faith belief; (e) a statement under penalty of perjury that the information is accurate and you are authorized to act; and (f) your physical or electronic signature. Repeat infringers will be terminated.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the fullest extent permitted by law, we expressly disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, secure, timely, error-free, free of viruses, or that any defects will be corrected. We do not warrant any results, including page views, clicks, conversions, earnings, or audience growth. You use the Service entirely at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TINYBIO, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, REPUTATION, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

These limitations apply to all claims, whether based in contract, tort, statute, or otherwise, and apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, in which case the limitations apply to the maximum extent permitted.

12. Indemnification

You agree to defend, indemnify, and hold harmless TinyBio, its affiliates, officers, directors, employees, contractors, agents, and licensors from and against any and all claims, demands, losses, liabilities, damages, judgments, awards, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your access to or use of the Service
  • Your User Content or links
  • Your violation of these Terms or any applicable law
  • Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
  • Any dispute between you and any third party

We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us.

13. Third-Party Services & Links

The Service may integrate with or link to third-party services (including payment processors, analytics, social platforms, and websites linked from user profiles). We do not control, endorse, or assume responsibility for any third-party services or content. Your use of third-party services is governed by their own terms, and any disputes are between you and the third party.

14. Modifications to the Service & Terms

We may modify, suspend, or discontinue any part of the Service at any time, temporarily or permanently, with or without notice, and without liability.

We may update these Terms at any time by posting the revised version with a new "Last updated" date. Material changes will be communicated as required by law. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.

15. Governing Law, Arbitration & Class Action Waiver

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Ohio, United States, without regard to conflict-of-law principles.

Mandatory Arbitration.

Except for claims for injunctive relief or intellectual property infringement, any dispute will be resolved exclusively through final and binding individual arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules. The arbitration will take place in Franklin County, Ohio, in English, before a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver.

YOU AND TINYBIO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

For any claim not subject to arbitration, you and TinyBio consent to the exclusive jurisdiction and venue of the state and federal courts located in Franklin County, Ohio.

16. Force Majeure

We will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, internet or power outages, cyberattacks, pandemics, or third-party service failures.

17. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to be enforceable. Our failure to enforce any right or provision will not be a waiver of that right or provision.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TinyBio regarding the Service and supersede all prior agreements and understandings.

18. Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may freely assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.
